The Institute of Law at ZRS Koper is the only institute in the country that approaches the phenomenon of law outside the established schematisation of the sciences, which places legal science in the social sciences. The genealogy of legal science in the Western tradition shows its close connection with the sciences that today belong to the humanities (philosophy, history, linguistics), thus opening up a new perspective that places le- gal institutes in the context of the broadest – Western and European – spiritual tradition that has shaped us historically. We are convinced that only in this way can the challenges of democratic culture be properly understood and responded to. This is why we also build on the communication of academic discourse with le- gal practice, which is why we cooperate with various organisations that bring together lawyers from different professions. In particular, we incorporate into our research the experience of working in the legal profession, as this remains the paradigmatic discourse for law. We also research issues of corporate governance in the public sector and the economy, especially in the context of social responsibility as a modern model of corporate governance.

Competences and achievements

Within the basic research project funded by the Slovenian Research Agency: »Corporate Governance as a Tool for Overcoming the World Economic and Financial Crisis« the researchers have prepared numerous proposals for system changes in the field of corporate governance of public and private companies, banking and public sectors, as well as in the field of human rights and minorities. A publication with the content related to the fundamental research project was issued.

Social contract in the 21st century P6-0400)

This research program investigates explications of the idea of social contract in the 21st century in social-sciences and humanities. Key challenges of today’s societies, which are becoming transnational, multicultural and increasingly conditioned by processes of individualization, atomization and transformation of the role of the nation-state and welfare, demand a fresh perspective and re-theoretization of the Enlightenment legacy of the social contract. The reconsideration includes social bonds of solidarity, ethics and citizenship education. The program group approaches these questions from comparative historical, philosophical and educational perspective, and, in this endeavour, brings together researchers in the interdisciplinary field of historical sociology, philosophy and educational studies. In addition, this research task is carried out in dialogue with international scholars who engage in debate in cross-generational, cross-regional and transnational contexts.

Theory of Punishment and Democratic Culture in Slovenia (J5-9342)

The project is dedicated to the analysis, understanding and confronting with the defects in the Slovenian democratic culture, which are manifested on the field of criminal policy. In the first place, the project approaches the genealogy of disorientation on this horizon. It finds it in the spiritual dynamics of the entire post-war Europe, marked by the competition between two pretenders for the superior social order, and in the geographical position of Slovenia, resulting in its exceptional competitiveness in relation to the West. And precisely in the case of criminal policy, the opportunity offered to Slovenia to create a system that would appear superior not only by the socialist criteria, but also by the advanced standards that were developed in the West. The aim of the project is to affirm a democratic culture through the legitimation of penalty. The punishment is a phenomenon that at first glance represents a counterpoint to a modern state, whose outmost concerns are the welfare, security and affirmation of the individuals. If we prove the legitimacy of democratic culture on the level of penalty, it is consequently proved through its entire organism.
